Have you or a loved one been seriously injured due to at work? Have you been in an workplace accident? You can maximize your recover in a workers' compensation lawsuit by hiring an attorney. OLG can help you obtain compensation for medical costs, lost income, physical pain, and psychological suffering.
Work accidents can be incredibly disruptive and result in a long and painful road to recovery. A serious injury can also affect your ability to earn a living now and in the future.
Fortunately, Kentucky has a workers’ compensation statute that provides the overwhelming majority of the state’s workers with no-fault workers’ compensation insurance.
Kentucky workers’ compensation is designed to pay medical and income benefits if you suffer a work-related injury that prevents you from doing your job. However, it can be difficult for injured workers to receive their full benefits. And the claims process can be complicated.
It sometimes takes an attorney’s help to make a claim and get the medical and other benefits you need. Our attorneys have extensive experience handling workers’ compensation claims throughout Kentucky. If you were injured on the job, please contact our workers’ compensation lawyers for a no-obligation free consultation.
Who is Eligible for Workers’ Compensation in Kentucky?
In Kentucky, almost all employers are required to carry workers’ compensation insurance or purchase their own self-insurance. The employer must also post a notice stating the name of the workers’ compensation insurance carrier.
What Workers’ Compensation Benefits are Available?
Injured workers can receive medical expenses, lost wages, compensation for permanent disability, and vocational retraining. Employers must pay all medical expenses reasonably related to the “cure and relief of the injury.”
What Should You Do If You Are Injured on the Job in Kentucky?
If you were hurt on the job in Kentucky, you should see a doctor immediately. Your medical needs always come first. Next, you should report your accident in writing to your supervisor. Under Kentucky’s compensation law, you have a legal duty to report your accident. The failure to notify your employer could result in your claim being delayed or denied.
When it comes to filing a claim for workers’ compensation benefits in Kentucky, even the Kentucky Labor Cabinet website says:
“Due to the complexity of the claims process, most injured workers hire an attorney to file a workers’ compensation claim for them.”
To file your claim, you must submit a completed Application for Resolution of Injury Claim and attachments and submit them to the Department of Workers Claims in Frankfort, Kentucky.
Once the claim is filed, it is processed for review and assignment and to make sure all the necessary information has been submitted.
You should then receive an Acknowledgement Letter from the KY Labor Cabinet. The claim is then assigned to the appropriate Administrative Law Judge (ALJ).
The next step is a Benefit Review Conference where you, the ALJ, your employer and their insurance company discuss your case, settlement options and consider other matters to help resolve your claim. This puts you at a disadvantage, since all other parties have extensive experience in dealing with workers’ compensation and likely this is your first workplace injury.
The alternative is to hire the Obi Law Group to handle your claim for you. As your attorneys, we’ll make sure your claim application is free of common errors that could lead to delays or denials.
